Anomalous authorization by a judge identified

Operadora of justice has ignored advice from PGN

Without hearing or take into account the opinions of the Attorney General's Office (PGN), the judge

authorized 10 adoptions of children in families.

The minors were placed in the Asociación Primavera, an entity that has no authorization from the Ministry of Social Welfare to operate as a nursery.

The adoption judgements were given in June and July this year, was found in the resolutions of judge Berdúo, that Prensa Libre had access to.

Josefina Arellano, head of the Unit for Childhood and Adolescence of the PGN, explained that the lawyers for the adoptive parents submitted the file in the Court of First Instance of families, that institution are required to fulfill certain requirements before endorsing the adoptions.

Procedure

According to Article 4 of the Law on Notarial Affairs Handling Litigation, if the PGN is opposed to adoption, the dossier is referred to a family court judge to resolve the request of the adoptive parents.

Arellano added that when asked to notaries fulfill certain requirements, there is no significance to the PGN oppostion to the adoption.

However, she said that the lawyers argued in their briefs that the Commission was opposed to such adoptions, and the judge ruled in favor of them, without allowing the PGN to present their arguments.

"The judge should take the opinion of the PGN in the process, because the study was done in each case was found missing requirements," said Arellano.

It should be mentioned that the sum Judiciary reported out of the resolutions to the PGN, and not in three days, as the law.

According to the documents, the judge ruled in favor between June 28 and July 26, and the PGN was notified the second week of August.

Out of time

For this situation, Arellano fears that applications for annulment brought by the PGN to reverse these adoptions are rejected out of time to present.

The Attorney General launched an investigation into the judiciary across the country to establish whether there are more cases like this, to bring legal action without effect. He also sent a circular to its branches and warned them about the new way they operate practitioners.

Mario Gordillo, Attorney General, said that Judge Berduo transgressed Article 108 of the Law on Protection of Children and Adolescents, and 51 of the Constitution, which establishes the legitimacy that the PGN has to be taken into account in all juvenile court proceedings.

"It is the duty of judges to run hearings and take into account the opinion of the PGN, because we are the legal guardians of children will be given up for adoption," he said.

Gordillo and Arellano last week visited Family judges to raise awareness so that the judge does not fall into the game of lawyers.

Omission

Among the requirements that were omitted by the judge Berdúo to resolve 10 files are inaccuracies in the birth of children and biological mothers.

Neither the files attached to the certification of registration of legal entities, showing the recording of the Asociación Primavera, and the record of appointing the legal representative,

Berdúo ruled that these documents were not required to approve the adoption because the mothers had delivered their children voluntarily and that motherhood was demonstrated by DNA tests were performed.

In four of these cases, Berdúo had refused to grant the adoption of the cases of lawyers

and

, but changed her mind.

Another benefit of counsel was Douglas Lainfiesta, from whom the Attorney General had requested a replacement birth certificate of the mother.

On three occasions Prensa Libre tried to talk to the judge Berdúo. However, through his secretary Olga Herrera Álvarez and the communication office, indicated that the judiciary, under Article 14 of the Family Courts Act, the processes of this class are not public.

Nursery without trace: No answer

The lawyers chose not to comment above. The nursery is not registered.

The newspaper sought the attorney Medina in the 45th Avenue 19-33, Zone 5, Chácara, registered address in the bar. However, the person who responded said that this property is not office, and she came in only occasionally.

The lawyer Valle was left messages with his secretary, but did not respond.

The notary Lainfiesta said in writing that the PGN process where the object is acting as legal representative of the adoptive parents, arguing it did not meet requirements that the law does not request an adoption process. He added that the notary in charge of the process, based on the Decree 54-77, which requested the file be referred to a family court.

Casa doubtful

 Asociación Primavera was operating illegally because it is not registered with the Ministry of Social Welfare. Its address is the 3rd. calle 20-54, zona 10.

Although the secretary, who did not give his name, said it was a law firm, neighbors contend that there are children.

Carmen de Wennier, head of the Social Welfare Department, said that this association does not appear in the list of the 126 licensed nurseries. In the electronic registry of legal persons of the Ministry of Interior, this entity is only registered as a partnership, and enrolled in Mixco on August 19, 1999.

List: The PGN questioned approvals

No. 9640/2007 Children: Wilson Caal of 2 years.  Adoptive mother: Theresa Marie Hopkins.

Irregularity: the child's mother was out of time recorded in the Register of Births. Attorney of adopters: Ilda Medina.

No. 17705/2007 Girl: Isabella Bámaca Ramirez, 1 years. Adoptive Parents: Jeffrey Wayne Salemi and Amanda Landy Salemi. Landy. The file missing registration number of the identity card of the girl's grandfather, who gave the consent.

Señalan a jueza por autorización anómala

Operadora de justicia habría obviado dictamen de PGN

Sin escuchar ni tomar en cuenta los dictámenes de la Procuraduría General de la Nación (PGN), la jueza Elia Berdúo Samayoa autorizó 10 adopciones de niños a familias estadounidenses.

Los menores estaban internados en la Asociación Primavera, entidad que no cuenta con autorización de la Secretaría de Bienestar Social para operar como casa cuna.

Las escrituras de adopción fueron otorgadas en junio y julio de este año, según se constató en las resoluciones de la jueza Berdúo, a las que Prensa Libre tuvo acceso.

Josefina Arellano, jefa de la Unidad de la Niñez y la Adolescencia, de la PGN, explicó que los abogados de los padres adoptivos presentaron los expedientes en el Juzgado de Primera Instancia de Familia, pues esa institución les exigió cumplir algunos requisitos antes de avalar las adopciones.

Procedimiento

Según el artículo 4 de la Ley Reguladora de la Tramitación Notarial de Asuntos de Jurisdicción Voluntaria, si la PGN se opone a una adopción, el expediente se remite a un juzgado de Familia para que un juez resuelva la solicitud de los padres adoptivos.

Arellano agregó que cuando piden a los notarios cumplir con determinados requisitos, no significa que la PGN se esté oponiendo a la adopción.

Sin embargo, dijo que los abogados argumentaron en sus memoriales que esta institución se oponía a estas adopciones, y la jueza resolvió a favor de ellos, sin correr audiencia a la PGN para presentar sus argumentos.

“La jueza debía tomar la opinión de la PGN en el proceso, porque en el estudio que se hizo de cada expediente se determinó que faltaban requisitos”, aseveró Arellano.

A lo anterior se suma que la citada judicatura notificó extemporáneamente las resoluciones a la PGN, y no en los tres días hábiles, como señala la ley.

Según los documentos, la jueza resolvió de manera favorable entre el 28 de junio y el 26 de julio, y la PGN fue notificada hasta la segunda semana de agosto.

Fuera de tiempo

Por esta situación, Arellano teme que los recursos de nulidad que interpuso la PGN para dejar sin efecto estas adopciones sean rechazados, por presentarse fuera de tiempo.

La Procuraduría inició una investigación en las judicaturas de todo el país para establecer si hay más casos como éste, para presentar acciones legales para dejarlos sin efecto. También envió una circular a sus delegaciones departamentales y les advirtió sobre la nueva manera en que operan los profesionales del Derecho.

Mario Gordillo, procurador general de la Nación, manifestó que la jueza Berdúo transgredió los artículos 108 de la Ley de Protección Integral de la Niñez y Adolescencia, y 51 de la Constitución, que establecen la legitimidad que tiene la PGN para ser tomada en cuenta en todo proceso judicial de menores.

“Es obligación de los jueces correr audiencias y tomar en cuenta los dictámenes de la PGN, pues somos los representantes legales de los niños que serán entregados en adopción”, aseveró.

Gordillo y Arellano visitaron la semana pasada a los jueces de Familia para concienciarlos de que no caigan en el juego de los abogados.

Omisión

Entre los requisitos que fueron omitidos por la jueza Berdúo al resolver los 10 expedientes están incorrecciones en las partidas de nacimiento de los niños y de las madres biológicas.

Tampoco se adjuntó a los expedientes la certificación del registro de personas jurídicas, donde conste la inscripción de la Asociación Primavera, y del acta de nombramiento de la representante legal, Enriqueta Noriega.

Berdúo resolvió que estos documentos no eran necesarios para aprobar la adopción, pues las madres habían entregado a sus hijos de manera voluntaria y que la maternidad se demostraba con las pruebas de ADN que se les practicaron.

En cuatro de estos casos, Berdúo había negado otorgar las escrituras de adopción a las abogadas Ilda Yaresa Medina Vielman y Alma Beatriz Valle Flores, pero cambió de opinión.

Otro de los favorecidos fue el abogado Douglas Lainfiesta, a quien la Procuraduría había solicitado una reposición del acta de nacimiento de la madre.

En tres ocasiones Prensa Libre intentó hablar con la jueza Berdúo. Sin embargo, a través de su secretaria Olga Herrera Álvarez y de la oficina de comunicación del Organismo Judicial indicó que, según el artículo 14 de la Ley de Tribunales de Familia, los procesos de ese ramo no son públicos.

Casa cuna sin localizar: No responden

Los abogados mencionados prefirieron no opinar. La casa cuna no está registrada.

Este diario buscó a la abogada Medina en la 45 avenida 19-33, zona 5, La Chácara, dirección registrada en el Colegio de Abogados. Sin embargo, la persona que atendió dijo que ese inmueble no es oficina, y que ella llegaba de manera esporádica.

A la abogada Valle se le dejaron mensajes con su secretaria, pero no respondió.

El notario Lainfiesta manifestó por escrito que la PGN objetó el proceso donde actúa como representante legal de los padres adoptivos, con el argumento de que no se cumplían unos requisitos que la ley no solicita en un proceso de adopción. Agregó que el notario a cargo del trámite, con base en el decreto 54-77, pidió que el expediente fuera remitido a un juzgado de Familia.

“Encontrándose el expediente en el Juzgado Primero de Familia (…) éste declaró con lugar las diligencias de adopción y ordenó que se otorgara la escritura pública, y de esta manera avaló la legalidad y transparencia de dichas diligencias”, expresó.

Casa dudosa

La Asociación Primavera estaría operando de manera clandestina, pues no está registrada en la Secretaría de Bienestar Social. Su dirección es la 3a. calle 20-54, zona 10.

Aunque la secretaria, que no dio su nombre, dijo que era una oficina de abogados, los vecinos sostienen que en ese lugar hay niños.

Carmen de Wennier, jefe de la Secretaría de Bienestar Social, aseguró que esta asociación no aparece en el listado de las 126 casas cuna autorizadas.

En el sistema electrónico del Registro de Personas Jurídicas del Ministerio de Gobernación, esta entidad sólo está registrada como asociación, y se inscribió en Mixco el 19 de agosto de 1999.

Irregularidad detectada: la madre del menor fue inscrita de manera extemporánea en el Registro de Nacimientos. Abogada de adoptantes: Ilda Medina.

No. 17705/2007 Niña: Isabella Bámaca Ramírez, de 1 año. Padres adoptivos: Jeffrey Wayne Salemi y Amanda Landy Salemi. En el expediente faltó número de registro de la cédula de vecindad del abuelo de la niña, quien dio el consentimiento.
