The CICIG is complainant in trafficking in persons

The International Commission against Impunity in Guatemala (CICIG) was admitted as a joint plaintiff in the case against Rosalinda Rivera, accused of being an "important piece" in a network that is dedicated to human trafficking and illegal adoptions.The accused is the sister of  a member of Partido Patriota (PP), Gudy Rivera.

Seventh Court of Criminal Instance CICIG admitted in late December last year, according to Yolanda Perez, head of the legal counsel of the commission, there is sufficient evidence pointing to the conclusion Rivera and conspiring with other people.

 Álex Colop of the Prosecution Against Trafficking in Persons of the Public Ministry (MP) says that tomorrow will present the indictment against Rivera, who is free on bail. The Third Board of Appeals granted him an alternative measure to revoke the order after the judge Miguel Angel Galvez, who issued the detention.

"There is sufficient evidence to believe that the accused was an important piece in a criminal network that is involved in illegal adoptions," says Colop (see: A criminal network). Attached below

In the alleged network of child trafficking also operated Pablo Antonio Díaz Pinto, legal course leader in the adoption of the child

, who was taken out of the country through an irregular procedure in January 2008.

Diaz is being prosecuted for trafficking, conspiracy and racketeering.

Besides the aforementioned, also accused Edwin Tomás Lima De León, secretary of the municipality of San Antonio La Paz, El Progreso, who is accused for the same crime as Diaz with the addition of  falsified paperwork, for extending a cédula to the alleged false mother of the

child.

The child is claimed by the true mother, who is also a key witness in the case against the network that link to Rivera.

According to the witness, it was Rivera who snatched her son outside a hospital  in the capital. Byron Facundo Hernandez Reyes, the notary, remains a fugitive .

La Comisión Internacional contra la Impunidad en Guatemala (CICIG) fue admitida como querellante adhesiva en el proceso contra Rosalinda Rivera, sindicada de ser una “pieza importante” en una red que se dedica a la trata de personas y adopciones ilegales. La acusada es hermana del diputado del Partido Patriota (PP), Gudy Rivera.

El Juzgado Séptimo de Instancia Penal admitió a la CICIG, a finales de diciembre del año pasado, y según Yolanda Pérez, jefa de la asesoría legal de la comisión, hay suficientes elementos que señalan a Rivera de concertarse con otras personas y conspirar.

Álex Colop, de la Fiscalía contra la Trata de Personas del Ministerio Público (MP), afirma que mañana presentarán la acusación contra Rivera, quien está libre bajo fianza. La Sala Tercera de Apelaciones le otorgó una medida sustitutiva tras revocar la orden del juez Miguel Ángel Gálvez, quien dictó la prisión provisional.

“Hay suficientes indicios para creer que la sindicada era una pieza importante en una red criminal que se dedica a adopciones ilegales”, afirma Colop (vea: Una red criminal).

En la supuesta red de tráfico de niños también operaba Pablo Antonio Díaz Pinto, supuesto mandatario judicial en la adopción del menor Gerson Canté, quien fue sacado del país por medio de un procedimiento anómalo, en enero de 2008.

Díaz está procesado por trata de personas, conspiración y asociaciones ilícitas.

Otros implicados

Además de los aludidos, también se sindica a Edwin Tomás Lima De León, secretario de la municipalidad de San Antonio La Paz, El Progreso, quien está acusado por los mismos delitos de Díaz con el agregado de falsedad ideológica, por haber extendido una cédula de vecindad falsa a la supuesta madre del niño Canté. El menor es reclamado por la verdadera progenitora, quien también es testigo clave en el proceso contra la red a la que ligan a Rivera.

Según la testigo, Rivera fue quien le arrebató a su hijo en las afueras de un hospital capitalino.

Permanece prófugo el notario Byron Facundo Hernández Reyes.
