"Tribunalul a acordat un termen de exceptie de 3 zile pentru introducerea recursului in cazul orfanului de la Madirjac, iar juristii de la DAS stiau ca termenul obisnuit era de 15 zile, ceea ce a dus la tardivitatea actiunii de la Curtea de Apel", a declarat purtatorul de cuvint de la DAS, Eliza Chirica Mandiuc. Totodata, judecatorii de la Curtea de Apel au respins si contestatia la executare depusa de catre reprezentantii DAS. Acestia cerusera, practic, suspendarea pe perioada judecarii recursului a procedurii de incredintare a pustiului noii sale familii stabilite la Segovia, in Spania. Dar, pentru ca juristii au intirziiat din necunostinta de cauza in depunerea ultimei actiuni care l-ar fi putut tine pentru totdeauna la Iasi pe Danut, magistratii au respins judecarea recursului inca de la inceput fara nici un fel de alte discutii in profunzimea cazului.
"Ma voi ascunde in dulap de spanioli"
Procesul de la Curtea de Apel era si ultima speranta a noilor "parinti" de la Madirjac de a-l avea pe micut in continuare in curtea lor. "El s-a invatat cu noi asa de tare incit cred ca nu ne va uita niciodata", a spus Maria Trifan, asistentul maternal care l-a luat in grija pe micut in urma cu doi ani. Mai mult, baietelul in virsta de numai 4 anisori in inceput sa se tina "cu dintii" de noua sa familie. Mama lui si-a pus sperante si in noul presedinte ales al Romaniei, Traian Basescu: "A iesit Basescu presedinte. Poate el nu mai da copilul la spanioli pentru ca numai Nastase vroia sa-l lase la ei". Si tot aceasta ne-a mai spus ca Danut a amenintat ca "ma voi ascunde in dulap de spanioli" in cazul in care va trebui sa-si paraseasca familia.
Copilul a fost pierdut din neatentie
Lupta in justitie pentru Danut a inceput in urma cu un an. La debutul cererii de adoptie a familiei de spanioli, Esteban Alba Juan (43 ani) si Lopez Herrero Maria de los Remedios (40 ani), in primavara anului 2004, asistentii sociali de la Iasi au fost de partea acestora pentru ca sefii lor din capitala avizasera dosarul strainilor. Dupa ce instanta a descoperit ca actele spaniolilor erau vechi de aproape cinci ani, iar acestia mai aveau adoptat un alt micut din Ucraina, DAS-ul s-a intors si a inceput sa lupte contra spaniolilor. Pentru a impresiona instanta de fond, asistentii sociali au smuls de la "mama" de la Madirjac a lui Danut o declaratie prin care aceasta isi lansa promisiunea de a-l adopta pe micut. Numai ca aceasta miscare nu a fost de ajuns ca judecatorii sa decida lasarea copilului la Madirjac. Mai ales ca spaniolii isi refacusera intre timp dosarul si prezentasera garantii financiare si emotionale indestulatoare ca instanta de la Iasi sa li-l acorde pe baietel. Potrivit actelor depuse la dosar, instanta de fond a decis incredintarea copilului de la Madirjac catre familia de spanioli, lasind la dispozitia DAS-ului o ultima portita de scapare, un recurs in trei zile. Numai ca aceasta a pierdut si aceasta ultima sansa de a-l pastra pe baietel mai mult din neatentie decit din neputinta. (Adina C+SLARU)
