Oklahoma v Penny Sue Tyler - Affidavit
8. On September 24, 2008, Penny Tyler told me she was married to Ardee Tyler and lived at a rural residence in the County of Major, State of Oklahoma. In August, 2005, Ardee and Penny Tyler adopted J.S.T. and moved her to their residence. Penny told me she was aware that sometime from January, to October, 2007, J.S.T. had been disciplined by Ardee Tyler on various occasions. This included one occasion where J.S.T. had been forced to spend overnight hours outside of their residence when the temperature was cool from 9:30 pm to 5:30 am. Penny admitted to me this was "not appropriate" discipline for a young child and that this was wrong to do. Penny also admitted that on one occasion during this same time period, Ardee had tied J.S.T. hands behind her back and then physically restrained her to a vertical post by the stairway of their residence, because J.S.T. had been caught by Ardee and Penny Tyler while stealing food from within the residence. Penny was also aware of a separate occasion where Ardee had tied J.S.T. hands together and then physicall restrained J.S.T. to her bed for two consecutive nights from the hours of 9:30 pm to 5:30 am. At the time of each of these instances, Penny agreed with Ardee of this was appropriate punishment for J.S.T., because she had been caught stealing food and she had "lied about it." However, Penny admitted to me she realizes this was "not appropriate" discipline for J.S.T.
