New laws restricting international adoptions. Foreigners have found a way to take children from Romania.
Foreigners who want to adopt a Romanian child and are not included in new legislation on international adoptions may opt for a version national adoptions. The main condition is stipulated by law that parents obtain foreign domicile in Romania and submit an application for adoption, with the same rights as Romanian citizens. Maximum period for which they have to spend in the country, before getting home, it is five years and to complete a national adoption, approximately one year.

Fentarea law has already started

Noua legislatie restrictioneaza adoptiile internationale. Strainii au gasit o metoda sa ia copii din Romania.
Strainii care vor sa adopte un copil roman si nu se incadreaza in noua legislatie privind adoptiile internationale pot opta pentru varianta unei adoptii nationale. Principala conditie stipulata de lege este ca parintii straini sa obtina domiciliul in Romania si sa depuna o cerere de adoptie, avind aceleasi drepturi ca si cetatenii romani. Perioada maxima pe care acestia trebuie sa o petreaca in tara, inainte de obtinerea domiciliului, este de cinci ani, iar pentru a perfecta o adoptie nationala, de aproximativ un an.

Ceea ce inseamna ca in maximum sase ani, un cetatean strain ar putea primi unul dintre cei aproape 900 de copii romani adoptabili.
Fentarea legii a inceput deja

Ea trebuie sa fie aplicata si respectata". De aceea, o solutie posibila pentru cei care au depus dosare de adoptie in perioada moratoriului si nu le-au fost acceptate este sa se mute in Romania.
In prezent, 28 de cetateni straini, din Statele Unite ale Americii, Spania sau Italia, se afla in curs de a primi in adoptie copii romani dupa ce au obtinut domiciliu in Romania, potrivit raportului final al Grupului pentru auditul dosarelor de adoptie internationala, publicat ieri. In plus, a adaugat secretarul de stat, parintii straini adoptivi pot pleca cu copilul din tara oricind, pentru ca exista dreptul la libera circulatie, insa vor fi monitorizati timp de doi ani.
Americanii si europenii protesteaza
Cele mai multe cazuri de adoptii internationale blocate in timpul moratoriului au fost din Spania, 543, si SUA, 318. Nemultumirile nu au intirziat sa apara si, din 2005, statul roman a fost chemat, pe rind, la Comisia Helsinki si in fata Parlamentului European pentru a explica tot ce se intimpla cu aceste cazuri. Mai mult, congresmenii americani au sesizat in repetate rinduri Guvernul roman in ceea ce priveste deblocarea adoptiilor internationale.
