Adoptive Father Arrested In Infant's Death

A Cleburne man who, along with his wife, was in the process of adopting twin baby boys has been arrested in connection with the death of one of the 3-month-old infants, according to Cleburne police.

The Cleburne Police Department arrested David Michael Giddens on Friday and charged him with injury to a child by omission. Giddens' bond was set at $150,000.

According to a Cleburne police press release, officers and emergency medical personnel responded to a call early Thursday morning because an infant at a residence in the 1100 block of Prairie Avenue had stopped breathing.

Police said the infant was examined by medical personnel, who found no obvious signs of foul play although the baby, Nicholas Rhea Hoffert, was dead.

The Johnson County medical examiner's officer later contacted Cleburne police to inform the department that Hoffert suffered head injuries near the time of his death, according to the release.

Hoffert and his twin brother were born in Michigan during November, and brought to the Giddens' home Dec. 24 pending legal adoption.

According to NBC 5, Child Protective Services now has custody of the surviving twin and the Giddens' 9-year-old daughter. CPS has no record of previous incidents involving the Giddens family.
