Sex-abuse Suspect Released By Judge

A man accused of sexually abusing his 8-year-old foster son was ordered released from Palm Beach County Jail on Wednesday.

David Allen Lindsey Sr., a cabinetmaker formerly of Boynton Beach, did not speak during the brief hearing before Palm Beach County Judge Edward Garrison. He was released on his own recognizance.

He has been charged with lewd assault, committing a lewd act and sexual battery on a person less than 12 years old.

Other similar charges are pending against Lindsey, who was arrested in 1987 and charged with sexually abusing his 19-year-old adopted son and another boy.

The 8-year-old boy lived in Lindsey`s Boynton Beach home between May 1986 and May 1987, court records show. He told Boynton Beach police detectives that the abuse began one week after he arrived at the home as a 6-year-old foster child.

``I think this case is garbage,`` Richard Lubin, Lindsey`s attorney, said. ``The child has denied the abuse took place. It`s an insult that this case was even filed.``

When Lindsey was arrested in 1987, the then-6-year-old boy told police he had not been sexually assaulted, according to court documents. Two weeks ago, the boy told police he better understands ``right and wrong`` and decided to talk to someone about Lindsey.

Lindsey, 44, who now lives in Ocala, turned himself in at the Palm Beach County Jail on Wednesday morning.
