Florida Department of Children and Families report on Nubia Doctor

Date: 2011-02-16

Florida Department of Children and Families, released the documentation of the case of Nubia Doctor. The report itself is attached as a PFD document. Several excerpts of the document related to investigations into Nubia's foster care and adoption placement are presented here.

December 21, 2004

Spoke with the Nurse Practitioner XXXXXXXXXXX(last name unknown), due to Nubia docter’s appointment that is scheduled for 12/21/2004. She wanted to make sure that Nubia did not miss this appointment because she has not had a follow up since January of 04. She stated that the child had to be seen by the docter 3x‘s a year. This counselor explained to the nurse that the foster parent never goes to the appointment with the children. She sends them with transportation. This counselor also told the nurse that when she calls the foster parent, she is going to tell her that she cannot take the child. The nurse explained to this counselor that the child is not in a good placement because the foster parent does not care for the child's well being if she does not attend the medical appointments with the child. The nurse also stated that the child may need to be in a medical foster care home. The nurse stated that she was going to call the head of the foster medical care units because this child is very medically needy and should not be missing appointments becasue the foster parent does not want to take her. She went on to state that maybe the brother could be placed with the child as well. She stated that she has a concem for the child if the placement is adoptive because the foster parent would then have the sole responsibility to care for the child and she does not believe that will happen. She has also stated that the children have not had their four year old shots. The children are in daycare without their shots. She does not know how this is possible.

January 26, 2005

Children seen for psychosexual evaluation. The children were appropriately dressed for visit. The children appeared to be happy and healthy. The daycare was neat and clean.
There were no signs of any hazardous conditions visible. The children were seen by Dr. Czchowicz, The doctor stated that the child, ubia stated that the foster parent, Mr. Barahona tickles her in front of eveyone. The Dr. stated that he does not think there is a I problem with the child. He went on to state that he had to report what the child said because he is required to do so. He also gave the children a date for the observational visitation, 2/7/05 @ 1pm contingent upon the father‘s schedule.

January 27, 2005

IN THE PAST, THE FOSTER FATHER (UNKNOWN) TICKLED NUBIA‘S PRIVATE AREA (VAGINA) WITH HIS FINGERS. THIS HAPPENED MORE THAN ONCE, AND THE INCIDENTS REPORTEDLY OCCURRED IN THE PRESENCE OF OTI-[ER ADULTS IN THE HOME. IT IS UNKNOWN WHEN THE INCIDENTS OCCURRED, AND IT IS UNKNOWN IF ANYTHING SUCH THING HAS BEEN DONE TO XXXXXX. THERE ARE OTHER CHILDREN in THE HOME, BUT IT IS UNKNOWN IF THOSE CHILDREN ARE ALSO FOSTER CHILDREN OR BIOLOGICAL CHILDREN OF THE PARENTS.

January 27, 2005

EDWARD SCZECHOWICZ IS A PSYCHOLOGIST THAT SAW NUB IA ON 1/26/2005. I·E STATED NUBIA WAS BROUGHT IN TO HIS OFFICE BY HER DCF WORKER BECAUSE SHE WAS SEE MASTURBATING RECENTLY, I·E STATED TO I-HS KNOWLEDGE APROX 40 PERCENT OF GIRLS AT NUBIA'S AGE MASTURBATE. HE WAS NOT VERY CONCERNED BECAUSE OF THIS. NUBIA DISCLOSED TO HIM THAT TI·E FOSTER FATHER TICLED HER PRIVATE PARTS. HE STATED TO CPI THAT HE FOUND HER STORY VERY QUESTIONABLE AND BELIEVES UNFOUNDED BECAUSE OF HOW SHE DISCLOSED TIE STORY AND BECAUSE OF CIRCUMSTANCES AROUND THE NARRATION OF SAID STORY. HE ALSO STATED SHE TOLD HIM OTHER ADULT MEMBERS WERE PRESENT. HE STATED IN HIS POSITION HE BROUGHT THIS ISSUE UP, HOWEVER DOESNT FIND MUCH VALIDITY TO NUBIA'S STORY. HE STATED TO CPI THAT IN HIS OPINION IT WOULD BE DETRIMENTAL TO WAKE THE CHILDREN UP AND CONFRONT THEM AT THIS TIME (AFTER 12AM).

January 28, 2005

F.F ALL FAMILY MEMBERS. BOTH MR AND MRS BARAHONA , THEY STATED THEY MADE CLEAR STATEMENTS THAT DENIED ABUSE ON THEIR PART, THEY STATED THEY HAVE MENTIONED IN MANY OCCASIONS TO THE CASEOWRKER MS HARRIS AND THE GAL, PAUL NEWMAN, ABOUT CONCERNS OF CHILDREN ACTING OUT SINCE VISITATION WITH BIOLOGICAL FATHER RESUMED. THEY ARE SURPRISED AS TO THESE ALLEGATIONS BUT ARE NOT SURPRISED AS TO CHILDREN'S PROBLEMS.
F/F NUBIA AND XXXX CHILDREN WERE INTERVIEWED INITIALLY SPEPERATELY THEN TOGETHER. NUBIA DENIED FO FATHER TOUCHED HER. BOTH CHILDREN DID MAKE STATEMENTS AS TO THEIR BIOLOGICAL FATHER. THEY APPEARED TO CALL BOTH DADDY WHEN SPEAKING IN ENGLISH BUT CALLED PAPA AND PAPI WHEN ADDRESSING THEM IN SPANISH CLEARLY DIFERENTIATING THEM. BOTH CHILDREN WERE SEEN WELL GROMMED AND DRESSED, FREE OF BRUISES/MARKS.

February 16, 2005

Children seen at home. The home was neat and clean and there were no signs of any hazardous conditions visible. The foster parents stated that they have bonded well with the children and want to adopt if the children do not return to their father. The foster parents talked about the allegations that were made and he stated that he would never molest any child. He stated that the Police and the P.I. came to the home and completed the investigation. he wanted to know what were the findings and if the case was still open. This counselor stated to him that the case was closed with no findings. He also was upset because the record would remain on file indefinately. The foster parents appeared loving and caring. They also have another child in the home named XXXXXX He is XXXXXXXXXXXXXXXXXXXXXXXX. They stated that they have room for one more child and the age range that is ideal is 0-5 years old. This counselor also explained that Nubia has a trust fund that is reaching capacity and for the foster parents to take the child to Walmart and place items on layaway that she needs so that we can make sure that the trust fund does not affect her SSI check. The foster parents stated that she needed some clothing and she would put the clothes on layaway as soon as possible. There are no services needed at  this time. The children had visited the on 2/14/05 Docter and does not need any immunizations until they reach the age of 5. The foster parent stated that she took Nubia for a follow up from her surgery and the Docter stated that he doesn't need to see her until she is older. he stated that she did not need to bring her because the surgery was in 2000.

February 17, 2005

Case staffed with atty. Counselor did not have JRSSR for staffing due to the court case that was on in the morning calendar was pushed back into the afternoon calendar. Status of case. Father is not in compliance with services. Counselor spoke with and requested the compliance status of the father and agency stated that the father was in compliance She stated that the father was continuing sessions with the Docter Chechowiz. This counselor assumed that the agency as all other agencies would have the referral in the file and refer to it once this counselor calls about the compliance. This counselor stated to the atty that the referral was made for the father's services in 6/04. The father was in non compliance in the first 1"RSSR. This counselor handed the father the referral for his services. This counselor stated to the atty that although there may have been confusion on this counselor`s part with the agency, it is ultimately the parent's responsibility once they have the referral and sign the case plan to complete the services. The atty stated that the time was waisted on the case and this counselor stated to her that it was not waisted on my part. This counselor called the father and he stated that at first that he was attending parenting classes and then he stated that he was not. He stated that his atty told him that once he finished his services with Dr. Chechowicz that he would not have to do any other
services. There are no services for the mother, she has been TPR'd. This counselor is to take down the corrected JR to the atty for review on 2/18/2005.

Children seen at home. The home was neat and clean. There were no signs of any hazardous conditions visible. The children were appropriately dressed for the visitation. The children were playing with other children residing in the home and they were watching television. The foster parent stated the concems for the case pending against the father. She asked if there were any new details that this cotmselor could provide her, This counselor stated that I have not spoken with the Detective from the Police Department. When calls are placed, the answering machine picks up. The Detective has not called either. She stated that the father has court for the allegations that brought the children into care on 4/18/05. She also stated that the Officer stated to her that the father was not to have any contact with any children at all. The Officer stated that DCF does not know what we are doing. This counselor explained to the foster parent that the Court ordered a psycho-sexual on the father and the Psychologist recommedations were that of the father‘s risk to the children was low. The courts then deemed that he should have visitation with his children. The Department does not have a copy of the no contact order that is in effect in criminal court. This counselor and the foster parent is in agreement to keep in touch on any further developments that either may have information on. This counselor also explained to the foster parent that there are relatives in Texas that want to adopt the children. She stated that she understood that if there were relatives that the  children would be placed with family first. She stated that if the relatives could not adopt then she and Mr. Barahona would be willing to sdopt. The children have no known illnesses at this time. There are no services needed at this time. Nubia‘s SSI was cancelled g and this cotmselor provided the foster parent with an emergency copy of the child's medicaid.

Recently, Nubia has been acting out. Nubia`s hunger has been uncontrollable, she sneaks and steals food, steals money, has hair loss, is very thin, unfocused, nervous and jittery. Nubia has also had an unpleasant odor. Recently, Nubia also missed two weeks of school due to heavy bleeding. Nubia’s adoptive mother has said that Nubia's behavior can be attributed to hormonal issues. However, the mother has only provided personal documentation written from her place of employment. There has been no medical documentation from Nubia's doctor regarding her medical issues. It is unkr1own when the last time was that nubia saw her endocronologist. In the past, it is believed Nubia's adoption was halted when Nubia was coming to school dirty while in the adoptive mother's care.

A couple of months ago, Nubia had a scratch on her nose. It was said that Nubia rubs her nose a lot and that she is always falling,

hands-on

Is it any surprise that hands-on professionals like nurses and teachers have a much better grasp of the situation than Department of Children's Services workers that do occassional home visits?

Additional input

Whether or not the school staff had a much better grasp of the situation is, well, academic.  Many times, a school counselor/staff member can jump to the wrong conclusions about the root cause to a child's behavior, and before a parent knows it, that parent is facing all sorts of false accusations.

If it's a non-medical emergency, it is the social worker's job to investigate the case further, and determine if the harm is being done at home, at school, or elsewhere.

If anything, the Florida DCF excerpt shows just how valuable additional input really is.  If there was no school to visit, or doctor visits to follow-up on, what would the investigator have to follow?

Imagine if these foster/adoptive parents were homeschooling, or the children were infant to pre-school age.  What other professional trained to asses a child's behavior would be contacted?  As it is, doctor visits are not mandated -- much to the concern of some, and to the relief of others.   However, in order to attend a school, a child needs to be inoculated for certain diseases.  Although, even this 'requirement' can be waived, if the parent chooses to cite individual medical, religious, or philosophical objections.  [See:  Public Health Law ]

So, once again, in terms of CPS, the child is forced to rely on the SW assigned to investigate specific adult care-takers, specific child safety/well-being, and a specific foster/adoptive home dynamic .

Using the example of a non-related case -- one that can easily represent many abused adoptee situations, I'd like to remind readers just how little if being done for the child who seems to be healthy and happy, and better-off, since the child was put in 'better care'.

Several people involved in the "Infant Charlie" case repeatedly denied being at fault for Charlie's fate, including the former director and supervisor of social services with the Huron County Department of Human Services, the assistant Huron County prosecuting attorney, Huron County commissioners and many others who came in contact with "Infant Charlie" during the abuse, several articles said.

"She looks and acts so prim and proper. She fooled everyone. No one thought she could be a child abuser," the assistant Huron County prosecuting attorney said about Charlie's adoptive mother in an Oct. 31, 1984, Journal article.

Charlie's first visit to Fisher-Titus Memorial Hospital was on Aug. 9, 1983, for a head injury. He went back in September for a shoulder injury that was later rediagnosed as a broken arm. Charlie also experienced a broken shoulder in January 1984 that was not reported to officials or treated by a physician, according to an Oct. 31, 1984, Journal story.

In February, Charlie was taken to the hospital because his body turned purple below his waist from a severed bowel. This injury required emergency transfer to a pediatric intensive care unit.

The doctor who treated Charlie said, "Charlie's heart stopped beating three times because of the shock to his system caused by the severed bowel," the article said. The injury has a death rate between 90 to 95 percent, the doctor said at the time.

The doctor said the severed bowel was caused by "a sharp force applied to the abdomen or back," according to the article.

It wasn't until the bowel injury that children services caseworkers and hospital officials suspected child abuse, and by then it was too late. Charlie was brain-damaged as a result of the injury.

Huron County authorities received a complaint in October 1983 from a baby sitter who alleged Charlie was being abused, an October 1984 Journal article said. After an investigation, Pluckhorn submitted to enter counseling, and Charlie remained in the home.

After years of the blame game and numerous court cases, Charlie was eventually placed with an adoptive family, and Ellen Pluckhorn went to jail, after pleading no contest to charges of felonious assault in June 1985.

[From:  Agency faced spotlight long before cages ]

'Lucky' for "Infant Charlie", he not only survived, but won a $15 million settlement from the various defendants who failed to notice he was being abused.

But isn't the following remark so very familiar AND haunting...

"She looks and acts so prim and proper. She fooled everyone. No one thought she could be a child abuser," the assistant Huron County prosecuting attorney said about Charlie's adoptive mother

If only I had a penny for each time that has been said about an abusive adopter.

I have a very hard time

I have a very hard time believing all of these people were fooled. I believe they see what they want to see. I've met some AP's I wonder who on earth approved them to adopt??

We still live in a culture where anyone who shows an interest in taking in a child is automatically seen as "good."

Limiting the search

It was once suggested to me, when it comes to adoptive parents, I have unrealistic expectations -- meaning, I expect AP's to be perfect, and not at all 'human'.  [It's such a treat having an arrogant AP tell me what it is I think, believe, or know.]

Um... no.  I had an Amother who had to be seen as "perfect".  I would not wish that burden on any child.  I never wanted 'perfect', I wanted a mother who was less mentally ill (than the mother-figure chosen for me) and I wanted a family that had fewer dysfunctional family members (too much to ask an adoption agency?).   And to clarify, I'd like readers to know, as psycho and as off-the-nut my Adad could be, (his pissed-off angry moods scared me), no one loved and accepted him more than me.  He had a great wicked sense of humour and had incredible life-experiences; he was my crazy flawed dad, and he was my everything -- until he too decided, for his sake, (and family politics), it was best to let me go.

As I got older, and understood the adoption-process much better, I had trouble with this one question:  Among all the people who wanted to adopt a healthy white baby born in Canada,  and among all the applicants The Sister Eugene Foundation received, the adoption agency responsible for my final-placement could not find a LESS dysfunctional family for me?  (I often thought there was no possible way they -- the social workers -- really searched and tried to find the best possible fit for me.  In my mind, they simply looked at the completed check-list, checked their inventory, and said, "OK, this will work.")

So... in terms of people seeing only what they want to see... I totally agree... I do believe in some cases, the notion that another alternative (or different solution to the same problem) can exist is such a terrifying concept and threat, some people will do or say just about anything, just so they won't have to admit, "I was wrong."  [Denial if often used as a tool for survival.]

And so I find myself coming full-circle:  Why do so many glorify the role of the adoptive parent so much, they lose sight of reality?  And who is being glorified more -- the women who want to be Amothers, or the men who agree to be Adads?

In another post, I dipped my virtual cyber pen into the deep well labeled "Glorified AP's".  I will highlight what I think are the best-points I tried to present:

Each time a big-name celebrity is given glorified praise for giving a poor 'orphan' (of color) the modern-day equivalent to the Willy Wonka golden ticket,  a not-so-subtle message gets sent and repeated, all over.   What's that message?  Wealthy white people make much better parents.... (and there's a bonus prize if we get law-makers in poor or corrupt countries to confirm it, and make special allowances and bend a few rules.)

But there's more.  If we look at cases like notorious Mommy Dearest, or Mia Farrow, we see the way in which Aparents with wealth and fame are depicted -- one minute they are saviors for taking-in a poor child, next minute they are victims of a scandal, brought upon by someone else, seeking attention.  How were the adopted daughters (later abused) supposed to act and behave?  Grateful... with no complaints.

Yes, the human-condition is flawed, making the glorification of certain groups/people that much more odd and complicated.

What bothers me is the mind-set of those who won't say anything truthful (negative) about an AP, because doing so will bring an unwanted consequence.  As my brother once told me, after I asked him to disengage from the mind-games my Amother would play, ( just so she could get what she wanted), his response to me was, "I'm not going to do or anything that will put my future income (inheritance) in jeopardy.  I know which side my bread is buttered. I'm not messing with that."

Who in their right mind wants to mess with the gravy-train?

What current and future members of the adoption community need is a culture of honesty... frig the 'sensitivity' given to PAP feelings.  If unstable, unpredictable and/or violent home environments are toxic to a child's future well-being, wouldn't it be wise to ensure such home environments are NOT chosen as 'ideal' for the adoptable child?

 [From: "Nicely put" ]

If you ask me, the best and worst person a home-study specialist (professional social worker) can investigate is the PAP who is no fool.

Conversely, the best SW to complete a home-study for a closet abusive/negligent PAP is the SW who doesn't ask too many questions, doesn't require too many in-person visits, and takes all answers/responses at face-value.

To err is human; making a mistake is not a sin... but social workers ought to know first-hand, too many errors, oversights, and mistakes can prove to be fatal for a child put in-care.

[BTW... I just thought of a new abbreviation for all in Adoptionland to consider:  PAAP (Potentially Abusive Adoptive Parent)  ]

I remember going to a Valentine party with my husband a long time ago.  We all played a game called: What do I know about my spouse?    We all filled in the blanks, and the couple who had the most right answers (as filled in by the spouse) won a prize.  I remember looking at my husband each time I came up with a wrong answer, wondering who he was... I didn't get one answer right.  I'd like to see an adoption agency add something like this to their requirements, from the beginning, and make it a face to face test where the questions are always changing so no one could cheat. YES, PAP's do cheat.

I really love that idea, but given the way various sub-sets of society support one another and network, (and educate each other in person and through the internet), don't you think seasoned adopters would give all sorts of home-study hints, tips, and techniques to newbie PAPs, so they can pass the personal Q&A with flying colors?

I know lots of wives who tell their groomed husbands what scripted lines they must regurgitate in public; I also know far too many scared-to-accidentally-slip submissive wives terrified to say or do anything that would go against their dominant husbands.

Surely a trained professional SW knows this sort of stuff about people, and private home-lives, too... wouldn't one think/hope?

I would love to see the format a SW follows for the "intensive home-study interview"... I'd love to see what an Outsider considers "intense".

Nothing intensive about it as I recall...

If I ever find one of our home studies, you're welcome to have a copy.  I'm trying very hard to remember the questions asked.  They were very general, and what we said was basically taken for truth.  My husband was not a very verbal man and so I did coach him on a lot of things; basically, I wrote his part of the home study for him as I asked him the questions and he hemmed and hawed around, not knowing what was required of him to say.  It reminds me of a couple of psychological tests I've taken, where you go online and they tell you that you should have more than one description of the "pictures" they show you.  Both times, the doctor did come up with the right "diagnosis" for me:  Deep depression and PTSD.  That was the truth.
They ask  you about fun times when you were growing up.  My husband told them he would never do to his adopted children what was done to him: abandoned to live with the maternal Grandparents.  But he did to them exactly what was done to him: abandonment, AND incest with my oldest daughter. He never told me about the incest he suffered as a child, not until it was too late and he was in prison.   When he told the SW he was abandoned by his mother because her husband didn't want him or his brother; wouldn't you think she would have had a clue?  As for me, I did a spiel based on the fact that all my childhood, my parents would tell me how good they were to me, and what a horrible child I was... So when it came out, at the time, I truly believed they were the wonderful parents; and hidden down deep was the thought that I was the one who was horrible.  My nick-name was "you sorry child."  Reminds me of Bill Cosby growing up thinking his name was "JESUS CHRIST!" and his brother Russell thought his name was, "DAMN-IT!"  How sad...
People are far from perfect.  People learn as children that there are certain ways to act, and certain things you don't tell.  As grown-ups we face a SW who says she isn't looking for perfect people who want to adopt because there are no perfect children.  We all relax after that spiel; but we still revert back to our learning as children.
So when we see all the abuse in adoptions, disrupted adoptions, and so many stories of how unhappy the AP's are because the SW didn't give them a perfect child... I wonder how adoption can continue.  Oh yes, I forgot... it's still a huge money making business.
