Agency lawyers go to baby Harvey hearing

COEUR D'ALENE, Idaho -- In the baby Harvey custody battle, attorneys representing the adoption agency LDS Family Services appeared in Kootenai County District Court in Coeur d'Alene, Idaho, on Tuesday afternoon.

The routine hearing was to decide what documents will be included in the record for LDSFS's appeal. All parties agreed all documents will be included. From here, the clock begins ticking on the expedited appeal, which may take up to 60 days.

LDSFS attorneys say they will take this appeal to the Idaho Supreme Court if necessary.

Jed and Cally Nielson, 26 and 24, of American Fork, have had 7-month-old baby Harvey in their care since his birth in late June. Birth father Matt Tenneson, 20, of Coeur d'Alene, is contesting the potential adoption. Birth mother Cammie Knight, 19, of Coeur d'Alene, stands by her decision to give up the baby for adoption by the Nielsons.

Tenneson missed the deadline to file for his paternal rights. However, an Idaho magistrate ruled Tenneson still had some parental rights. LDSFS is contesting that ruling.
